1. Acceptance of These Terms

Welcome to 713 Philharmonic. By accessing or using this website, our mobile app, the live audience-response platform known as the VS Experience, our ticketing system, the community gallery, the volunteer portal, or any related service (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. Your Account

Some features require a registered account. You agree to provide accurate information, to keep your credentials secure, and to take responsibility for all activity under your account. You must be at least 13 years old to create an account; users under 18 require a parent or guardian's consent. You may not transfer or sell your account.

3. Acceptable Use & Community Conduct

You agree not to:

• Harass, threaten, or demean any other user, artist, staff member, or volunteer;
• Upload or share content that is unlawful, hateful, defamatory, sexually explicit, or that infringes another's intellectual property;
• Attempt to disrupt, overload, or reverse-engineer the Platform or its data;
• Use the Platform for any commercial purpose without our written consent;
• Impersonate another person or misrepresent your affiliation.

We may suspend or terminate access for conduct we believe violates these Terms or harms the community.

4. The VS Experience — Audience Voting Conduct

The VS Experience is an audience engagement and cultural response feature — it is not a competition, sweepstakes, contest, or prize draw. There is no wagering and no prize is awarded. To keep the experience fair and meaningful:

• One vote per person per round. Creating multiple accounts, using multiple devices to vote repeatedly, or coordinating mass voting to manipulate results is prohibited.
• No automation. Bots, scripts, macros, browser automation, or any non-human voting method are not permitted and will be discarded.
• No vote trading or buying. Votes cannot be sold, exchanged, or offered as an incentive.
• Moderator authority. Moderators may pause, reopen, extend, or close a round at any time to keep the experience running smoothly. Rounds may be voided in cases of suspected abuse.
• Results. Vote totals reflect audience response at a moment in time and are shared for cultural engagement. They are not an official ranking and carry no prize or legal standing.

Abuse of the voting system may result in votes being excluded and your access to the Platform being revoked.

5. Tickets & Events

Tickets grant admission to a specific event subject to the event's stated policies and venue rules. Tickets are non-transferable for resale above face value where prohibited. Refunds are handled per the event's published refund policy and applicable law. We reserve the right to refuse entry or remove attendees who are disruptive.

6. User-Submitted Content (Community Gallery)

When you upload photos or other content to the community gallery, you confirm you own or have permission to share that content, and you grant 713 Philharmonic a non-exclusive, royalty-free license to display, reproduce, and adapt it for the Platform and related promotional use. All uploads are moderated before they appear publicly. We may decline or remove any upload at our discretion.

7. Intellectual Property

All branding, text, imagery, recordings, and design on the Platform — other than content you own and submit — are the property of 713 Philharmonic or its licensors and are protected by intellectual property laws. You may not copy, redistribute, or adapt them without written permission.

8. Third-Party Links & Integrations

The Platform may link to or integrate with third-party services (payment providers, social media, streaming platforms). We are not responsible for the practices or content of those services, and their terms apply to your use of them.

9. Disclaimers

The Platform is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or that results will be accurate. To the fullest extent permitted by law, 713 Philharmonic disclaims all warranties, express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, 713 Philharmonic and its officers, staff, and volunteers shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, access, or tickets, or the conduct of other users.

11. Indemnification

You agree to indemnify and hold 713 Philharmonic harmless from any claim, damage, or expense arising from your use of the Platform or your violation of these Terms or the rights of another.

12. Privacy

Your use of personal information is governed by our Privacy Policy. By using the Platform you consent to the practices described there.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Platform; continued use after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved in the courts located in Houston, Texas, except where prohibited.
